In a continuing campaign of unconstitutional lawfare against this administration, yet another leftist DISTRICT Judge believes he can decide U.S. National Immigration Policy.
A federal judge on Monday blocked an experimental Trump administration policy that requires asylum seekers to wait in Mexico while their cases make their way through the immigration court system, a major blow to President Trump as border crossings have surged to their highest point in more than a decade.
U.S. District Court Judge Richard Seeborg in San Francisco enjoined the Migrant Protection Protocols policy days after outgoing Homeland Security Secretary Kirstjen Nielsen pledged to expand the program. The policy began in January.
This obviously unconstitutional ruling prohibits President Trump’s program of requiring asylum seekers to wait in Mexico for their hearings, as opposed to allowing them to disappear into the interior of the United States, never to be seen again—unless caught committing a murder or a kidnapping. As I’ve noted here, here and here, the leftists are all about lawfare.
It’s time President Trump used some lawfare of his own—aggressively. This could be the case where the President makes his stand. He could issue a Presidential Finding that “hereby determines that the Federal District Court in San Francisco does not have standing to issue such an enjoinment of Federal Protocols affecting the entirety of the United States Immigration Policy. Moreover, the lowest court that has standing to make such a determination is the DC court of Appeals.”
Of course, there will be the usual caterwauling from the left and their enablers, the Vichy Republicans. But with over 1 million illegal aliens already tagged for deportation, but lost in the interior, we certainly can’t afford to add to that number to the tune of over 100,000 per month.
