Last week the Biden administration scrambled to prepare for the new influx of migrants after Title 42 expires this Thursday.

Title 42 was enacted in the early days of the pandemic under Trump and allowed Border Patrol agents to turn away migrants on the basis that they might be infected with COVID. Since 2020, 2 million migrants were turned away without admitting them to the country to await asylum
hearings. The Biden administration has repeatedly attempted to end the rule, but Republican-backed legal challenges have kept it in place … until now.

With the rule expiring May 11, the administration’s own projections calculate that Border Patrol “encounters could rise to 11,000-13,000 encounters per day” from the current daily level of around 6,000. Already, many migrant processing centers are filled to capacity.

By issuing 1,500 active duty troops to the border Tuesday, Democrats made what one MSNBC analyst admitted was nothing more than a “tiny gesture.” The troops will assist the 2,500 already at the border in serving administrative functions, and will not partake in any law enforcement,
CNN reported.

Albert Einstein famously said that, “Insanity is doing the same thing over and over and expecting different results.” This perfectly sums up the situation on the border. The administration consistently touts the way it’s improving the situation on the border. But are Democrats really so stupid as believe that their failing policies have worked these past two years?

On the one hand, the administration is necessarily reacting to the polls. Border policy is Biden’s most unpopular policy issue among dozens, according to Morning Consult. A majority of all voters (56 percent) disapprove of Biden’s decision to remove Trump era border controls.
Crucially, only 31 percent of Independents and a small majority of Democrats (60 percent) approve of the move. Biden is going to have to do better if he hopes to win a second term.

However, Einstein was only half right; there is another option to describe why Democrats continue to do the same thing over and over again. Perhaps their policies aren’t failing, but achieving the result they actually desire. Perhaps they aren’t stupid, but sinister.

A closer look at the border strategy after Title 42 suggests that Democrats want to appear as if they are doing something to secure the border, while not actually curtailing the massive influx of new migrants into the country. The Department of Homeland Security proposed a strategy to
mitigate a surge at the border, but the wording of the rule shows how they are hiding the ball:

The proposed rule would encourage migrants to avail themselves of lawful, safe, and orderly pathways into the United States, or otherwise to seek asylum or other protection in countries through which they travel, thereby reducing reliance on human smuggling networks that exploit migrants for financial gain.

The policy is meant to mirror Trump’s Third Country Transit Asylum Rule, which required migrants to apply for and be denied asylum in at least one other country on their way to the southern border. Unlike the Trump rule however, the new policy complements expanded legal options for migrants to seek asylum in the US. Part immigration policy, part public relations strategy, the proposed rule is meant to minimize the surge of high profile, illegal crossings but not actually reduce the overall inflow of impoverished Latin Americans into the country. In fact, it aims to better facilitate it.

A Politico report explains what the DHS means by “lawful, safe, and orderly pathways.” The administration announced plans last week to establish “immigration processing centers” throughout Latin America in anticipation of Title 42’s expiration. They will be used to screen migrants to determine their eligibility for entry into the US prior to continuing on to the southern border. If eligible, they will be referred for a variety of “lawful pathways” such as refugee resettlement, parole programs, family reunification, or other labor pathways. Additionally, the administration will expand family reunification programs to more countries, including
Guatemala, El Salvador, Honduras and Colombia.

The U.S. plans to screen between 5,000 and 6,000 migrants a month at the new processing centers, Politico reported. Processing centers in Guatemala and Colombia should be running in the “coming weeks,” with other hubs potentially under way in Ecuador and Costa Rica.

These pathways ensure that migration will not be meaningfully decreased in the long-term, but just kept out of the public eye. They will help relieve migrant processing centers that are already stretched to capacity and make for unseemly news coverage. They will also help cut down the
horror stories of Cartel-run human smuggling that often end in catastrophe.

As DHS Secretary Alejandro Mayorkas put it, “The whole model is to reach the people where they are — to cut the smugglers out and to have them avoid the perilous journey that too many do not make. But we are beginning in Guatemala and Colombia. We are beginning at the level
that I described, and we will scale up.”

Democrats do not want to deter immigration, they just want to make it more efficient while keeping the American public in the dark.
