For all the tolerance and enlightenment that modern society claims, Americans are losing hold of a fundamental right as citizens of a free country: the right to speak their minds and voice their opinions in public without fear of being shamed or shunned.

Robyn Strader—a nurse practitioner with multiple, advanced degrees—was fired from CVS Pharmacy after CVS had accommodated her religious beliefs without issue for six and a half years. Why? Because CVS wants to force its employees to prescribe contraception even when it violates the employee’s religious beliefs.

Politically and jurisprudentially, it’s not all doom and gloom.

The New York Times reports that Justice Breyer intends to retire from the Supreme Court at the end of this term. If President Biden can pick a nominee who is palatable to the 50 senators who caucus with his party, he will be able to replace Breyer fairly quickly.  

Stephen Breyer is retiring at the end of the current Supreme Court term, at the age of 83, after 27 years on the Court. We wish him good health and a happy retirement. We wish we could be equally cheery about the prospect that his replacement will be faithful to the Constitution and laws of the United States.  

For conservative advocates watching the courts, these cases have a lot of significance, which means this term could mark an even sharper turn to the right than the non-lawyers among us may be expecting.

For the last year, we’ve heard one commentator after another tell us that American democracy is in crisis.
